These Terms of Service (the “Terms”) govern your use of the Bytedocks service provided by Auerswald Marketing S.L., Ctra. del Cap de la Nau Pla, 126-1-18, 03730 Xàbia (Alicante), Spain, VAT ESB09946799 (“we”, “us”, “Bytedocks”). By creating an account or using the service you accept these Terms and our Privacy Policy.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
Bytedocks operates a proxy network covering residential, mobile and ISP networks together with the related dashboard, APIs and documentation. We provide the service with the diligence required of a professional service provider under Spanish law. We do not guarantee that the service is bug-free, that the open web is always reachable, or that any specific anti-bot system will accept our IP addresses.
We publish an indicative network uptime target of 99.9%. Service credits, where applicable, are calculated and applied automatically and are your sole and exclusive remedy for any service interruption.
You are responsible for the confidentiality of your API keys, the activity of your sub-users and any usage attributed to your account. If a key is compromised you must rotate it from the dashboard immediately.
You may not use the service for any purpose listed in the Acceptable Use section below. Violation of those rules entitles us to suspend or terminate your account without prior notice.

We monitor for violations of this section using aggregate signals (volume, target patterns, abuse reports). We do not log request contents. If we suspect a violation we may pause your account and ask for clarification before terminating.
All prices are quoted in the currency shown in your dashboard and exclude any applicable VAT, which will be added in accordance with Spanish tax law. EU business customers providing a valid intra-Community VAT number may be invoiced under the reverse-charge mechanism.
Pay-as-you-go: you authorise us to debit your prepaid balance for usage. Subscription plans: you authorise a recurring charge to your payment method. Annual plans: we issue an invoice payable within 14 days.
If a payment fails we will retry for up to 7 days and may suspend the account until payment is received. Outstanding amounts may accrue interest at the rate set out in Law 3/2004 of 29 December on measures against late payment in commercial transactions.
If you are a consumer resident in the European Union, you have the right to withdraw from this contract within 14 days without giving a reason, in accordance with Royal Legislative Decree 1/2007 (the Spanish Consumer Protection Act).
By starting to use the service immediately (for example by generating an API key or making your first proxy request) you expressly request that performance begin during the withdrawal period and acknowledge that you will lose your right of withdrawal once the service has been fully performed. For any partial use, fees will be charged pro rata.
You may close your account at any time from the dashboard. We may suspend or terminate the service for material violations of these Terms (including the Acceptable Use section), sustained non-payment, or where required by law or competent authority.
On termination we will retain the data we are legally required to keep (in particular invoices, for the periods set out in our Privacy Policy) and delete or anonymise the rest within 30 days.
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by Spanish law, we exclude all implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Our aggregate liability for any claim arising out of or relating to these Terms or the service is capped at the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special or punitive damages, lost profits, lost data or lost business opportunities.
Nothing in these Terms limits liability that cannot be limited under Spanish law, including liability for fraud, wilful misconduct, gross negligence, death or personal injury, or the statutory rights of consumers.
These Terms are governed by Spanish law. Any dispute arising out of or relating to these Terms or the service will be submitted to the exclusive jurisdiction of the courts of Alicante, Spain, except where mandatory consumer-protection law provides that a consumer may bring or be sued only before the courts of their place of residence.
We may amend these Terms from time to time. We will notify account owners by email of material changes at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the amended Terms.
